Murphy v. Rio Rancho Center

New Mexico

(New Mex. Ct. App., filed March 5, 2026): Arguing that the double-digit punitive multipliers likely violate due process. The U.S. Supreme Court has set forth clear due process limits for the imposition of punitive damages that must be adhered to in this case. The District Court violated defendants’ due process rights by applying the incorrect standard and not assessing the ratio between punitive and compensatory damages. The punitive damages award is unconstitutionally excessive because the ratio between punitive and compensatory damages exceeds accepted limits.  The court must reduce the punitive damages award to a constitutionally acceptable ratio because this case does not justify a double-digit ratio.
