(Ky. App., filed May 28, 2025): Arguing that the court erred in finding that heavy motor trucks, such as tow trucks, are inherently dangerous.  The trial court’s approach would have a chilling effect on Kentuckians contracting for any services involving trucks. Making insurers liability in tort simply for offering policyholders roadside assistance could deter them from providing an important public service.  Additionally, imposing a new extra-contractual risk on auto insurance carriers could harm Kentucky’s auto insurance marketplace, hurting drivers.
