(9th Circ., filed May 26, 2026): Arguing that rehearing should be granted to clarify the standards applicable to establishing class-wide injury.  The panel decision reflects confusion about evidence needed to establish class-wide injury and an objective legal standard for materiality cannot excuse the lack of a class-wide means of proving injury.
