(KY., filed August 26, 2025) : Arguing that in a wide range of cases, identification of suspicious claims activity has led to investigations that have revealed fraud and soft tissue injuries are particularly susceptible.  The risk of fraud also is particularly high in mass tort litigation. Failing to apply the common interest privilege here will deter individuals, employers, and insurers from investigating, identifying and reporting suspicious claims activity.
